SB1370: Patriotic youth groups; school access

the limited list of organizations considered “patriotic” is problematic. This bill is designed to exclude some groups and privilege others. Who gets to decide what “patriotic” means?

SB1435: schools; libraries; explicit materials; classification

Extends criminal liability to employee or independent contractor who acts with negligence, may not refer a minor to anything “explicit”. Will be used to stifle speech in public schools and libaries, esp. when it comes to LGBTQIA+ topics, sex educaiton, etc.

SB1573: judicial determinations; religious sectarian laws

Would ban courts from using “religious sectarian law” in their decisions, which sounds great… EXCEPT there’s a provision stating unless it’s “based on Anglo-American legal tradition and principles”. This translates to white Christian nationalism and is an attempt to marginalize non-Christians and the non-religious. Courts should not use any religious laws, whether that’s canon law. Sharia law, or the 10 Commandments. This is a loophole that will be used to sneak in religious historical British and American law; for example, the The Supreme Court used a 13th century British law to justify taking away abortion rights. Plus, the “originalism” doctrine of interpreting the Constitution keeps us mired in the 17th century, when women and non-white people had no rights

SB1741: Religious Instruction on School Time

Would allow religious groups to pull students from class for religious instruction in public schools. Would expose students to religious indoctrinationtion by forcing every school district to let private religious programs take children off-campus for religious instruction.

Released time programs were originally designed to accommodate religious families, but these olicies have been exploited by religious groups like LifeWise Academy, a Christian nationalist organization that treats public schools as mission fields where they can minister to students without their families present. Forcing schools to allow such unregulated programs takes instruction time away from students and exposes nonreligious, LGBTQIA+, and other students who don’t agree or participate to bullying and harassment.

SCR1006: Schools; biological sex; requirements

SCR1006

Sponsor: Majority Leader John Kavanagh (R-AZ-003)

Summary: Usage of “multi-occupancy” facilities (restrooms, locker rooms, and sleeping quarters) in public schools  must be designated based on a person’s biological sex at birth. Students must submit “satisfactory evidence” of their “biological sex” (such as an original birth certificate).

Students who encounter a member of the opposite sex in a multi-occupancy facility may sue the school for “psychological, emotional, and physical harm” and recover attorney fees.

School employees may not refer to a student under 18 by a name or pronoun that differs from their biological sex unless the school has written permission from a parent. No school can require an employee to use a pronoun that differs from a person’s biological sex if doing so violates the employee’s religious or moral convictions.

This is a “concurrent resolution” intended for the ballot, if it passes the Legislature, it will be sent to Arizona voters for final approval rather than the Governor.
